Representative Kiley Sends Letter to Acting DOL Secretary Su Demanding a Suspension of the Independent Contractor Rule

WASHINGTON – Representative Kevin Kiley (R-CA) sent a letter to Acting Department of Labor Secretary demanding the immediate suspension of the latest independent contractor rule. There are ongoing lawsuits in Texas, Georgia, Tennessee, and Louisiana.

“Today’s implementation of the independent contractor rule is indeed a dark day for American workers. Acting Secretary Su and the Department of Labor should stay implementation of this new rule until the federal courts have resolved the many legal issues surrounding this terrible regulation,” said Rep. Kiley.

Background:

The Biden Administration rule attempts to restrict the ability of American workers to classify as an independent contractor and take advantage of the flexibility it provides. The rule creates a non-exhaustive, six-factor litmus test for unelected bureaucrats to interpret and decide who is and who is not classified as an independent contractor. It also casts as large a net as possible and gives less legal certainty to independent contractors impacted by the regulation.
